4. The new amending

Ordinance also permits the transfer

to an asylum of any prisoner whom

the Medical Officer of the prison

considers likely to become insane.

This change has probably been

introduced on humanitarian grounds,

but it has been suggested that a man

should not be sent to an asylum

before he actually becomes insane.

5. The Secretary of State

would be grateful to receive Sir John

Gilmour's observations on the points

raised above.

6. It is requested that the

enclosed copies of the Ordinances

should be returned to this Department

in due course.
